4. User Responsibilities

As a user of our Service, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Use the Service only for lawful purposes
• Not misrepresent your dental practice or services
• Comply with all applicable healthcare regulations and advertising laws
• Not use the Service to collect or store personal health information (PHI) beyond what is necessary for lead generation
• Obtain proper consent from leads for marketing communications

5. Intellectual Property

5.1 Our Content

The Service, including its original content (excluding user-provided content), features, and functionality, is owned by SmileConvert and is protected by international copyright, trademark, and other intellectual property laws.

5.2 Your Content

You retain ownership of any content you upload to the Service (logos, images, testimonials, etc.). By uploading content, you grant us a non-exclusive license to use, display, and distribute that content as necessary to provide the Service.

5.3 AI-Generated Content

Content generated by our AI systems (transformation videos, audio messages) is licensed to you for use in connection with your dental practice marketing. You may not resell or redistribute AI-generated content.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMILECONVERT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
